1. Introduction
Welcome to Finbuk, a financial record-keeping and compliance tool operated by myfinbuk. Finbuk is designed to help small business owners in Nigeria manage their bookkeeping, track transactions, and stay informed about their tax obligations.
By downloading, installing, or using the Finbuk application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application. These terms apply to all users of Finbuk, including free and paid tiers.
2. Eligibility
To use Finbuk, you must be at least 18 years of age and operate or be affiliated with a legitimate business in Nigeria. By creating an account, you represent and warrant that:
- You are at least 18 years old.
- You are a registered business owner, sole trader, or authorised representative of a business entity.
- All business information you provide — including your business name, address, Tax Identification Number (TIN), and registration details — is accurate and up to date.
- You are solely responsible for any errors arising from inaccurate information provided to the app.
3. Account Registration
To access Finbuk, you must create an account using a valid Nigerian mobile phone number. You are responsible for:
- Providing an accurate phone number and business details during registration.
- Maintaining the confidentiality of your login credentials, including any one-time passwords (OTPs) sent to your phone.
- All activity that occurs under your account. If you suspect unauthorised access, contact us immediately at support@myfinbuk.com.
- Not sharing your account access with any other person or entity.
myfinbuk reserves the right to suspend accounts where suspicious or fraudulent activity is detected.
4. Permitted Use
Finbuk is designed exclusively for legitimate business record-keeping, invoicing, expense tracking, and financial visibility. You agree to use Finbuk only for lawful purposes.
You must not use Finbuk to:
- Record, conceal, or facilitate fraudulent, illegal, or tax-evasion transactions.
- Misrepresent your business income, expenses, or tax status.
- Use the app on behalf of another person or business without proper authorisation and disclosure to that party.
- Attempt to reverse-engineer, copy, or distribute any part of the Finbuk application or its data.
- Transmit malware, spam, or any harmful content through the app or via any connected communication feature.
Violation of these use restrictions may result in immediate account suspension and, where applicable, reporting to relevant Nigerian authorities.
5. Financial Data & Accuracy
Finbuk is a bookkeeping and compliance guidance tool. It does not constitute professional tax advice, legal counsel, or financial advisory services. Tax estimates, VAT calculations, and compliance reminders provided by Finbuk are based on publicly available information and the data you enter.
You are solely responsible for:
- Verifying the accuracy of all figures before submitting returns to FIRS, LIRS, or any tax authority.
- Keeping your transaction records accurate and up to date within the app.
- Consulting a qualified accountant or tax practitioner for formal compliance decisions that carry legal or financial consequences.
myfinbuk makes no warranty that the tax estimates or compliance guidance provided are free from error, and accepts no liability for financial or legal consequences arising from reliance on app-generated figures.
6. Payments & Subscriptions
Finbuk is currently free to use during its beta period. All features are available at no charge to registered users.
myfinbuk reserves the right to introduce subscription tiers or paid features in the future. If and when paid tiers are introduced, you will receive at least 30 days' advance notice via in-app notification and, where possible, SMS. You will not be charged without your explicit consent.
Any future payment transactions will be processed through secure, verified payment processors in accordance with CBN guidelines.
7. Intellectual Property
The Finbuk application, including its design, user interface, source code, branding, trademarks (Finbuk, myfinbuk), and all associated content produced by myfinbuk, are owned by or licensed to myfinbuk. All rights are reserved.
You retain full ownership of the business data you enter into Finbuk — including your transaction records, customer data, invoices, and financial history. myfinbuk does not claim ownership of your data. You may export or delete your data at any time (see Section 9).
You grant myfinbuk a limited, non-exclusive licence to process your data solely for the purpose of delivering the Finbuk service to you. This licence does not extend to selling, licensing, or sharing your data with third parties for commercial purposes.
8. Data & Privacy
Your use of Finbuk is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By creating an account and using the app, you consent to the collection, storage, and use of your information as described in the Privacy Policy.
We process your personal data in compliance with the Nigeria Data Protection Act (NDPA) 2023 and the Nigeria Data Protection Regulation (NDPR).
9. Termination
You may delete your Finbuk account at any time by navigating to Profile → Delete Account within the app. Upon deletion, your personal information will be removed from our active systems in accordance with our data retention policy (typically within 30 days), except where retention is required by law.
myfinbuk reserves the right to suspend or terminate your account at any time if you:
- Violate any provision of these Terms of Service.
- Use Finbuk for fraudulent, illegal, or abusive purposes.
- Attempt to interfere with the app's functionality, security, or other users' accounts.
We will attempt to notify you before suspension unless immediate action is required for security reasons.
10. Limitation of Liability
To the fullest extent permitted by Nigerian law, myfinbuk shall not be liable for:
- Any financial loss, tax penalty, or legal consequence arising from reliance on tax estimates or compliance guidance provided by Finbuk.
- Loss of data due to device failure, network issues, or user error.
- Indirect, incidental, or consequential damages arising from your use of or inability to use Finbuk.
- Any third-party actions or services linked from or integrated with Finbuk (e.g., payment processors, telcos).
Our total liability to you for any direct damages shall not exceed the amount you have paid to myfinbuk in the 12 months preceding the claim (or ₦5,000 where no payments have been made).
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
Where disputes cannot be resolved through court proceedings, both parties agree to first attempt resolution through good-faith negotiation or, failing that, through a mutually agreed mediation process in accordance with Nigerian law.
